Terms of Service

These Terms govern your use of LoftyMCP, a connector operated by Real Estate OS. By using the Service, you agree to them. If you don't agree, don't use the Service.

1 The Service

LoftyMCP ("the Service") links your Lofty CRM account to AI assistants that support the Model Context Protocol, such as Claude by Anthropic. After you authorize access, the Service lets the connected assistant read from and write to your Lofty account on your instruction. The Service is provided free of charge.

2 Eligibility

You must be at least 18 years old and have a valid Lofty account that you are authorized to connect. By connecting, you represent that you have the authority to grant access to that account and the data within it.

3 Your responsibilities

You are solely responsible for all activity that occurs through your connection — including any action initiated by you or by an AI assistant acting on your instructions: reading, creating, updating, or deleting records, and sending any communications (emails, SMS, or calls) through your Lofty account. You acknowledge and agree that:

• AI assistants act on your prompts and may take actions you did not specifically intend. You are responsible for reviewing and confirming actions before relying on them.
• You are responsible for the accuracy and legality of everything you do through the Service, including compliance with all laws that govern your communications and your handling of personal information (for example, the TCPA, CAN-SPAM, and applicable privacy laws).
• You will not use the Service for any unlawful purpose, to infringe the rights of others, to access data you are not authorized to access, or to interfere with or circumvent the Service's security.

4 AI outputs

The Service relies on third-party AI that generates outputs which may be inaccurate, incomplete, or unsuitable for your purpose. Outputs are not professional, legal, financial, or real-estate advice. You are responsible for independently verifying any output before acting on it.

5 Third-party services

The Service depends on third parties, including Lofty and Anthropic (Claude). Your use of those services is governed by their own terms and policies. We do not control and are not responsible for third-party services, their availability, or their handling of your data beyond what we describe in our Privacy Policy.

6 No warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be preserved or accurate.

7 Limitation of liability

To the maximum extent permitted by law, Real Estate OS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, business, or goodwill, arising out of or relating to your use of the Service — including any actions taken through an AI assistant, any communications sent, or any change to or loss of your data. Our total aggregate liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100). Because the Service is provided free of charge, you acknowledge this allocation of risk is reasonable.

8 Indemnification

You will defend, indemnify, and hold harmless Real Estate OS from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your acts or omissions, the actions you direct an AI assistant to take, the communications you send, the data you access or modify, or your violation of these Terms or any law.

9 Data

Our collection and use of information is described in our Privacy Policy. You are the controller of the personal information in your Lofty account — including your contacts' and clients' information — and you grant us the limited rights necessary to process it on your instruction in order to provide the Service.

10 Suspension and termination

You may stop using the Service at any time and revoke access from your Lofty account settings. We may suspend or terminate access at any time, including for any violation of these Terms. Provisions that by their nature should survive termination — including the warranty disclaimer, limitation of liability, and indemnification — will survive.

11 Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Service after a change means you accept the updated Terms.

12 Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.
